- Terms & Conditions
- 1. Introduction
- These Terms & Conditions govern the use of ActuallyGoodWebsites website-building services.
- By using our services, you agree to comply with these Terms.
- 2. Services
- We provide website design, development, and related services.
- Specific service details, pricing, and timelines will be outlined in individual agreements.
- 3. User Responsibilities
- You agree to provide accurate and complete information for website development.
- You are responsible for ensuring that your website content complies with all applicable laws and regulations.
- You must not use our services for any illegal or harmful activities.
- We will raise your business to a professional visual standard. You are expected to uphold this standard in your trade. Failure to do so may result in misrepresentation, for which we are not liable.
- 4. Payments & Refunds
- Full payment is required upfront before the commencement of any work.
- A full refund will only be issued if the website is declined by the customer and will not be used.
- Once the website has been approved or made live and connected to your domain name, a refund is no longer available.
- All of our monthly rolling services (e.g., social media management) can be canceled at any time, but once a payment has been made, it is non-refundable.
- 5. Industry Exclusivity & Conflict of Interest
- We operate on a conflict-of-interest basis, meaning we work with only one business per industry in a specific area.
- In some cases, we may work exclusively with a particular industry, ensuring no competing businesses are served.
- Industry classifications follow the definitions governed by Companies House.
- To qualify for our conflict-of-interest clause, you must be using a rolling service with us. If you are not subscribed to a rolling service, you do not fall under the conflict-of-interest protection.
- You can receive a website from us if we do not already have another client in your industry, according to our conflict-of-interest policy.
- If we have already built a website for a business in your industry and they are not currently protected under our conflict-of-interest clause, you are eligible for all and any of our services, including website-building services.
- We measure our success by the success of our clients. If your business remains stagnant and does not show growth because it is blocked, we reserve the right to move on and work with another business in your industry that is committed to growing with us.
- If we move on and work with another company in your industry, it will not affect the current assets (e.g., website) we have created for you up until that point.
- However, you will no longer be eligible to join our rolling services, nor will we continue to focus on improving your business.
- Termination due to missed obligations: If any of the following occurs, you may be deemed ineligible for continued services or the conflict-of-interest protection:
In such cases, we reserve the right to: - Terminate services.
- Remove your eligibility for the conflict-of-interest protection.
- Replace you with another client in your industry.
6. Intellectual Property
- We retain ownership of any templates, tools, or proprietary technologies used in the development process.
- Once the project is completed and approved, ownership of the final website design and all digital assets will be transferred to you.
- We do not retain ownership of any digital assets once the site has been approved.
- Showcasing Work: You agree that we have the right to use any and all work created for you to showcase our services. This includes using your website or any digital assets in promotional materials, portfolio, website, or social media, for the purpose of promoting our business.
- 7. Limitation of Liability
- We are not responsible for any direct, indirect, or incidental damages arising from the use of our services.
- 8. Termination
- We reserve the right to terminate services if you violate these Terms or engage in any unlawful activities.
